Welcome to NexGen Cards. This website and our retail storefront are operated by NexGen Cards. Throughout the site, the terms “we”, “us” and “our” refer to NexGen Cards. By visiting our store, accessing our website, or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

1. Market Volatility & Pricing Accuracy

  • TCG Market Fluctuations: By purchasing from us, you acknowledge that the trading card game (TCG) and collectibles market is highly volatile. Prices for sealed hobby boxes, booster packs, and singles can fluctuate rapidly based on supply, demand, and tournament play.

  • Price Locking: We do not offer price matching, price adjustments, or retroactive refunds if an item’s market price drops or rises after your purchase is completed.

  • Errors: In the event that a product is mistakenly listed at an incorrect price due to a system or typographical error, we reserve the right to cancel or refuse any orders placed for that product, even if the order has been confirmed and your payment processed. If canceled, a full refund will be issued immediately.

2. Pre-Order & Cancellation Policy

  • Commitment to Buy: Because we must commit to allocation numbers with distributors months in advance, all pre-orders placed with NexGen Cards are considered binding commitments.

  • Allocation Adjustments: On rare occasions, manufacturers or distributors may cut product allocations. If we receive fewer items than ordered, we will fulfill pre-orders in the exact order they were received. Any unfulfilled pre-orders will be fully refunded.

  • Cancellations: We reserve the right to charge a 15% cancellation fee on any approved pre-order cancellations to cover non-refundable merchant processing fees and administrative costs.

3. Product Authenticity & Anti-Fraud Measures

  • Tamper-Free Guarantee: We strictly enforce a factory-sealed policy. We guarantee that all sealed hobby products are 100% authentic and have never been weighed, searched, or resealed.

  • Verification: To protect our business and our community from fraud (such as card swapping or resealing), we cross-reference internal batch logs, weights, and high-resolution packaging data before shipping high-value orders.

  • Account Termination: Any customer found engaging in fraudulent chargebacks, friendly fraud, or attempting to return altered/opened merchandise will have their account permanently banned from our digital and physical store locations.

4. Shipping, Delivery, and Risk of Loss

  • Fulfillment: All online orders are subject to standard processing times. Shipping tracking details are provided automatically once a shipping label is generated.

  • Address Restrictions: Customers are solely responsible for ensuring their shipping address is correct at checkout. We are not liable for packages misdelivered or lost due to an incorrectly entered address.

  • Risk of Loss: The risk of loss and title for all items purchased pass to you upon our delivery of the package to the shipping carrier (USPS, UPS, FedEx). If a package is marked as "Delivered" by the carrier but is missing, you must file a claim directly with the shipping carrier.

5. Prohibited Uses of the Service

In addition to other prohibitions set forth in the Terms of Service, you are prohibited from using the site or its content:

  • For any unlawful purpose or to solicit others to perform unlawful acts.

  • To violate any international, federal, or state regulations, rules, or local laws.

  • To submit false or misleading information during checkout or verification.

  • To scrape, harvest, or use automated bots to purchase limited-edition products or manipulate inventory.

6. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to conflict of law principles.

7. Changes to Terms of Service

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
